In order to establish whether claimants are working or are capable or working, insurance companies sometimes hire professional investigators to check claimant’s activities. Such professionals, known as private investigators, conduct background checks and investigations which include interviews, data checks, photographs, and surveillance videotapes. It is not illegal for self insured employers or an insurance company to investigate a claimant’s activities, including photographing them “in plain view” at their home or in public. Surveillance photographs and videotapes are uniformly submitted as evidence at workers’ compensation hearings throughout the State to combat claimant’s false allegations of disability.
