Mediation is a procedure where the parties attempt to informally solve disputes they may have with the insurance carrier or self-insured employer. At the mediation the parties may appear pro se (without an attorney), with an attorney, or with another representative, including a union representative. The other side may appear with their attorney or representative. The mediation is conducted by a trained mediator provided by the Division of Workers’ Compensation at no charge to the claimant. Mediation is not a commonly used alternative dispute resolution procedure. Most parties elect the settlement conference option so that they have access to the services of a prehearing ALJ.
