An administrative law judge will only hear an issue if it is “ripe”, which means that there is an issue currently in controversy which can be decided by that ALJ.  If any person requests a hearing or files a notice to set a hearing on issues which are not ripe for adjudication at the time the request for hearing is made, that person may be assessed reasonable attorney fees and costs of the opposing party in preparing for such hearing or setting.  (Section 8-43-211(d), C.R.S.).
