Six-Months Closure Rule

If a claimant files a claim and does nothing with the claim for at least six (6) months, the insurance carrier or self-insured employer may try to have the case dismissed for “lack of prosecution.”  The Director will allow the claimant to explain their inactivity, however, and they may be given permission to proceed with their claim.  (Section 8-43-207(1)(n), C.R.S.).
